認定違法兼職監院彈劾管中閔

【台灣醒報記者林稚雯台北報導】由於認定台大管中閔於101年2月至104年2月任職政務人員期間，常態性以匿名方式為雜誌撰寫社論，獲取年約65萬兼職報酬，違反公務員服務法第14條第1項公務員禁止兼職之規定，監察院彈劾審查會15日上午以7票對4票通過彈劾案，最終懲處將由公務員懲戒委員會裁定。但對此，文化大學新聞系主任胡幼偉發文表示，政務官應邀在媒體闡述政策，是該做之事，應受表揚而非彈劾才對。

行政院前政務委員，後兼任國家發展委員會主委的管中閔於任職政務人員期間，自民國99年起，持續透過匿名方式為壹週刊匿名撰寫〈壹評論〉、〈壹觀點〉、〈壹看法〉等專欄，其中101年2月至104年2月任職政務人員期間，每年獲取約65萬兼職報酬。

彈劾案審查委員會主席陳師孟表示，本案經匿名檢舉後啟動調查，據壹傳媒公文回覆，自管中閔擔任台大教授期間即透過口頭約定為專欄撰稿，再經國稅局稅務資料，確認壹傳媒台灣分公司以預扣方式每月為管中閔扣繳稅額，所得名目為薪資。

委員王幼玲也指出，自去年4月列案調查以來，曾三度約詢管中閔，但其以身體不適、忙碌等緣由拒絕約詢，因無法獲得本人釐清，故彈劾案是根據蒐集到的資料加以認定。

王幼玲說，從壹傳媒公文、國稅局稅務資料等內容，可見管中閔獲邀入閣擔任政務人員長達3年之期間，並未終止與壹傳媒的合作關係，其違反公務員服務法第14條第1項禁止兼職之規定，事證明確。

委員蔡崇義強調，針對本次管中閔彈劾案，單一聚焦在有充分事證、確知其違法的「定期為壹週刊撰寫社論」一事之上。

蔡崇義指出，我國法治對公務員兼職向來採取嚴格禁止的立場，實務上雖然允許公務員在不妨礙工作與本質之性質或尊嚴、不涉及職務之事務實，得予投稿賺取稿費，但前提是限於偶一為之、非經常固定的性質。以社論的性質來看，匿名撰稿代表主筆者代表社方立場，而其固定預先扣繳所得的方式可見雙方合作據有相當固定性予週期性，據此認定此舉實質上屬兼職行為無誤。

本彈劾案審查委員共計13名，實際出席11名，彈劾成立票7票、不成立票4票，將移送公務懲戒委員會做最終裁定，而彈劾調查報告預計於1至2個月內出爐。
